Second edit: Ok, I just went for a walk and thought about this, and it makes total sense. First of all, just because the House is adjourned doesnt mean theyre not working. There are many good reasons to adjourn: they just pulled an all-nighter to certify the vote, theyve all been through a harrowing ordeal and need to rest and catch up, the FBI needs to sweep the Capitol for explosives, offices need to be cleaned and the building repaired, there are unresolved questions about the Capitol police and security, and I believe that the constitution mandates that congress meet in the Capitol building. Moreover, canceling the session allows congressional leadership to engage in emergency discussions and planning. This is a smart, obvious, strategic move.

(1,604 posts)This must be initiated by the White House and the Vice President in particular according to the 25th Amendment. Once initiated, then Congress would be called back into session, and the President has the opportunity to contest. If the President fails to contest within fourteen days, then the House and Senate must then approve by a single majority vote that the Vice President will become the President. It would take a month (28 days) for this whole process to take place.
I think what has happened in practice is that Trump is effectively under house arrest. He has no de facto power at this point. Should a situation arise where a decision absolutely needs to be made, it will be done under Pence. No one will take his phone calls on Capitol Hill. The Joint Chiefs of Staff have already weighed in that they do not see Trump as being in the chain of command, and the Supreme Court is currently adjourned. At this point, we're running out the clock
Pelosi may choose, once Biden is in office, to put Impeachment on the table, but I doubt it. More likely, I suspect that should Trump attempt to pardon himself, this WILL be fast-tracked to the Supreme Court, which will no doubt rule that the pardon cannot be used as a vehicle for a President to commit, either directly or via conspiracy, a crime. Even with the originalists on the court, there is a clear intent within the Constitution that this particular case for pardons is in fact without merit.
