It's still trespassing.

BOTH the officer and the trespasser are committing crimes at this point.

may present a problem in many cases. They were invited in. I almost wonder if it was strategic because it was so obvious. They are being arrested right now, but, unless you can show the police were coconspirators, you might have a problem getting a conviction if they went in after being waved in by a cop.

The police that did it. I suspect there are a bunch of laws that can be applied to them. They may try the out of fearing for their lives because of the size of the mob.

Many cops were brave and got injured trying to stop these thugs.

I do have to wonder that even if you are overwhelmed and afraid of taking physical action, why you aren't at least shouting vacate this building - you are in this building unlawfully. Every last one of them that just stood around the protestors doing nothing needs to be fired and charged.

Obviously, what they should have been doing was arresting them.

knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds.


If you took the scenic tour, the FBI is coming to pay you a visit as soon as you've been identified.

the charges will mount if they got INSIDE the capital. 5000 people could easily be charged as that was easily the number who breached the soft perimeter with the help of some Capital Police, who also helped them to get inside.

Insidious and lucky it was so poorly planned and executed

Now, those identified as breaking windows and doors, shouldn't be a problem.

Of course, you have to find a jury to convict them if the charges and potential sentence are tough enough. That might be a problem.

Honestly, I think we need to toughen our protest laws and consequences for everyone -- No gunz or other weapons at protests, no body armor, breaching clearly marked areas is an offense and grounds for crowd control measures up to shooting, etc.
