I'm not sure those wouldn't still be "federal charges" which would be covered by a presidential pardon.

No state has jurisdiction.
Moreover, even if DC became a state, the capitol grounds would still be federal territory.

then it falls under the federal pardon power.

Also I think an incitement to riot would be a hard case to prove in the legal code. It is the combination of Trump's position and the speech which makes it impeachable. Also his response to the violence when he had a duty to respond as the President. All those are reasons for removal.

If reports are true that Pence has told him he won’t pardon Trump, then I think he will do it realizing it’s his last option
