The NY court system does that. The NY Bar Association is just a voluntary professional organization.

12. In NY, it requires court action to disbar-- a very long and involved process.

In most states, the state bar-- like the state medical, veterinary, & dental boards-- can take action on their members, though it is not a simple process and the appeals processes mean that it doesn't occur quickly.

But, NY is a particularly involved process for attorneys.

that lawyers don't have to belong to. Attorney discipline in NY is handled by the Appellate Division of the state Supreme Court and the discipline and grievance committees; only those agencies can disbar a lawyer.

8. No. What you've probably seen are articles saying he got booted from the NY Bar Association.

That is not disbarment. The NY Bar Assn is a professional organization for NY lawyers, like the AMA is to American doctors.

On Jan. 11, 2021, the New York State Bar Association (NYSBA) released a statement saying it was launching a “historic inquiry” into removing Rudy Giuliani, the personal attorney for U.S. President Donald Trump, from its membership because of his role in inciting the deadly attack on the U.S. Capitol.

This news prompted some on social media to believe that Giuliani had been disbarred, meaning he could no longer practice law.

The New York State Bar Association is a professional association, not a regulatory agency, meaning even if it ultimately did strip Giuliani of membership, he could still practice law. It’s up to the attorney discipline committee of the appellate division in the New York state court system to decide whether to disbar him, Susan DeSantis, a spokesperson for NYSBA told Snopes in an email.

But New York State Sen. Brad Hoylman, who chairs the state Senate Judiciary Committee, filed a complaint with the appellate court on Jan. 11, 2021, seeking to revoke Giuliani’s license to practice law in New York.

Giuliani hit with disbarment complaint, faces possible expulsion from New York lawyers association

NEW YORK — The New York State Bar Association will consider expelling President Trump's personal lawyer Rudolph W. Giuliani, and a state lawmaker is seeking his disbarment after inflammatory comments during a rally preceding last week's deadly riot inside the U.S. Capitol.

Hours before the pro-Trump mob breached security and stormed the building, Giuliani encouraged the president’s loyalists to fight the election results “by combat.” Five people, including a Capitol Police officer, died during the attempted insurrection.

In a statement Monday, the bar association said it has received “hundreds of complaints in recent months” about the former New York mayor and his failed bid to help Trump overturn his loss to Joe Biden.
