How do Hawley and Cruz defend breaking their oath?

The oath states "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely..."

Are the insurrectionists not yet designated as "enemies?" If they are, is that not a violation of their oaths?

I'm simpleminded, I'm sure I'm missing something critical.
