The people making the argument are also the ones who get to judge whether or not it holds up.

If several of them don't change their minds... it holds up.

The real issue is that McConnell refused to call the Senate into session to hold the trial prior to the expiration of Trump's term.

To allow the Senate majority leader to effectively nullify an impeachment in this way is the real issue here.
