Brandenburg v. Ohio

https://en.wikipedia.org/wiki/Brandenburg_v._Ohio

Brandenburg v. Ohio, 395 U.S. 444 (1969), was a landmark decision of the United States Supreme Court interpreting the First Amendment to the U.S. Constitution.[1] The Court held that the government cannot punish inflammatory speech unless that speech is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action".[2][3] : 702

https://www.oyez.org/cases/1968/492

Brandenburg, a leader in the Ku Klux Klan, made a speech at a Klan rally and was later convicted under an Ohio criminal syndicalism law. The law made illegal advocating "crime, sabotage, violence, or unlawful methods of terrorism as a means of accomplishing industrial or political reform," as well as assembling "with any society, group, or assemblage of persons formed to teach or advocate the doctrines of criminal syndicalism."

They did not address this after all, so I assume they will deal with it in their final remarks after Repubs have presented their arguments. It's just as well they didn't borrow trouble beforehand by discussing it. There's no guarantee what the Repubs are going to say given they have so little to work with.

Pic that everyone has been circulating was taken AFTER rally. No idea if that's true but interesting.

Something is very fishy about the NG deployment. Cap police head Sund said he asked for guard 6 times. ArmySec/ pentagon says no one asked.

What's interesting is that the National Guard is not a rapid response group. Like guard members are literally at home or at work. In other words, not good for "get your ass down here asap, we've got trouble."

But they could have been called in before.. prearranged. DC mayor did that... But just for traffic. She has no jurisdiction over Capitol.

based on the question of Constitutionality, to let that go not only because it is without merit, but because it is besides the point as they are tasked with hearing out the prosecution in a trial in which they are sworn to participate.
