I can hardly believe there is any debate. Every woman has a right of CHOICE.

(26,045 posts)It might have been safe, if RBG had lived long enough to allow Biden to replace her. But, with Barrett now on the court, things are anything but sure. If the current court overturns Roe, even if they don't invoke "natural law" in their decision to declare that all "unborn children" have an equal status to the already-born (thus automatically making all abortions homicide) -- which I personally expect them to do -- you still won't be able to get any relief through federal law, as Republicans will be able to filibuster any such bill. That leaves it up to each state, and there are "pro-life" majorities in most state legislatures. And, even if your state isn't one of them, most states (unlike Washington, where I live) never bothered to codify abortion rights themselves, because Roe covered it for them. That means that, should Roe be overturned, the laws in those states will automatically revert to where they were as of 1972 which, in most cases, means that abortion would be re-outlawed unless the legislature enacts new ones. And you can count that, even in many "progressive" states, the Religious Right might be able to exert a strong lobbying effort to prevent such an occurrence, as a lot of state legislators, even if their personal position is pro-choice, might not want to allow themselves to be painted as a "baby-killer" in the next campaign.
So, yeah, I'd say "very volatile and uncertain" is probably an understatement, if anything.

(4,858 posts)...it would be the most divisive ruling since Dred Scott. It would pull the country apart, even more than it is now. I think it would lead to state governments in the blue states openly ignoring a Supreme Court ruling, and it would certainly be a major test for Biden. Conservatives would taunt liberals for hypocrisy, comparing them to the segregationists defying the Court after Brown v Board of Education. The possibility of mischief such a ruling would unleash is unimaginable. I personally feel the country might not survive the controversy--literally not survive. Returning it to the states would be bad enough. This would be a total disaster.

(90,827 posts)If a woman who miscarries goes to her doctor, he is supposed to report it and to assign a reason for the miscarriage. HIPAA be damned we are talking a potential murder charge here. She is to be investigated. The product of a miscarriage at any stage is to be cremated or buried, and the woman is to pay for it.
They are merciless, fanatical, and they mean it.
All those personhood laws that get passed in the heels of some awful crime where a pregnant woman gets shot in the belly making it a two-fer on the murder charge those are pretty much Step One.

(22,443 posts)They would report a miscarriage, and then whoever is in charge of prosecuting would decide whether to order an investigation of the person who had a miscarriage. As with all restrictive laws, it would be exercised inequitably.
HIPAA also doesn't cover every healthcare provider.

(10,584 posts)There are girls and women who now/soon can not get life saving healthcare in 19 states. Womens healthcare and choice is more than just abortion rights. Any weakening of healthcare for women leads to more rights being taken.
