An accused U.S. Capitol rioter known online as Bullhorn Lady has been ordered to explain why her pre-trial release shouldnt be revoked after Law&Crime reported that she appeared to have been recorded in a bookstore wearing a mask with holes in it in possible violation of court-ordered conditions for staying out of jail.
A used book store in western Pennsylvania showed an individual who appeared to be Rachel Powell wearing a mesh mask. The problem was that Powell, as a unique condition of her pretrial release, was ordered by Chief U.S. District Judge Beryl A. Howell to wear a mask whenever she leaves her residence.
On Friday, Senior U.S. District Judge Royce Lamberth, a Ronald Reagan appointee, said in crystal clear fashion that he felt the defendants actions mocked the earlier court order. Judge Lamberth said that Powells decision to appear in a video wearing a mask with holes in it at work mocks compliance with the Courts Order setting a condition of pre-trial release that she wear a mask whenever she leaves her residence.'
No reasonable person could think that defendants mask complied with that condition, which Chief Judge Beryl A. Howell imposed to ensure that defendant would not pose a risk to the health and safety of the community when she left her house,' Lamberth said. The judge, saying he does not take [Powells] willingness to flout the Courts order lightly, ordered the defendant to provide within 10 days an explanation in writing as to why she should not be jailed ahead of trial once again.

(6,476 posts)a judge can't impose criminal sanctions without evidence before the Court and due process requires a reasonable time to present such evidence. News reports of wrongdoing are technically hearsay (with exceptions)

(7,526 posts)One of the definition's of the word mask in the oxford dictionary is "a covering for all or part of the face, worn as a disguise, or to amuse or terrify other people." What Rachell Powell is wearing clearly is a partial cover of her face mean to amuse other people. The judge is clearly not amused, but is that actionable by the court?
Should Powell be found guilty, I imagine the judge will look to actions like this and lean more toward the upper end of the sentencing guidelines than the lower end of them. Until then though, I wonder if the judge will just modify the order to state a mask which meets CDC guidelines for coronavirus but otherwise stew in anger.

(6,476 posts)I should have added that above. So this hearing will be about the contempt of the Court's order not the underlying crime. But yes conditions of bail can be revoked.You don't fuck with Federal Judge's order
