Dominion filed a lawsuit against Lindell for $1.3 billion in February, alleging defamation from Lindell accusing the voting company of election fraud. Lindell previously announced on Steve Bannon’s War Room: Pandemic podcast that he had planned to retaliate legally against Dominion for their violation of Americans’ First Amendment rights. “You’re also going to have MyPillow going after Dominion in a countersuit and that’s going to your First Amendment speech,” Lindell said.


Lindell also announced that lawyer Alan Dershowitz was joining his legal team. Dershowitz described the case as being potentially one of the biggest cases for free speech and the First Amendment.

18. Wow. That is ridiculous!

First, defamation involves the claim that the speech or writing of the defendant is FALSE (in which Dominion would have to be spreading lies about Lindell, like say that voting machines stole an election with the help of the Chinese Communist Party). Dominion hasn't really even spoken about Lindell, except to say that he is spreading lies (which is part of their suit).

Second, Free Speech? Lindell has no standing to be claiming violation of Free Speech. Libel and Slander are specifically excluded from protection. Dominion is not a government entity so any tort action they take is as one private entity suing another private entity for damages in a civil court. WTF is Dershowitz even saying about the First Amendment.

This is stupid and will be thrown out. Lindell has no case and is just trying to use the courts like Trump. There should be sanctions on Dershowitz if he even files anything that frivolous.
