(28,979 posts)Rep. Mo Brooks (R-AL) has refused to be served in a lawsuit over his role in inciting the Jan. 6 attack on the U.S. Capitol, according to an attorney for Rep. Eric Swalwell (D-CA).
The California Democrat has sued President Donald Trump, Donald Trump Jr. and Rudy Giuliani for their own roles in the Capitol insurrection, and the complaint also alleges that Brooks incited the riot with his speech ahead of the violent assault on the democratic process, reported Axios.
"We have been attempting to serve our complaint on Mo Brooks for more than a month," Swalwell attorney Philip Andonian told Punchbowl News.

A Washington, D.C., judge on Tuesday denied a Tennessee man's request to go home before trial in his U.S. Capitol riot case, citing the decision in the case of another notable Jan. 6 suspect.
Joseph Lino Padilla, 40, of Cleveland, Tennessee, was arrested on several charges after investigators say evidence surfaced of altercations between him and police guarding the Capitol building.
Padilla is accused of arguing with police officers at a barricade outside the Capitol building and later throwing a flagpole at a group of officers, according to federal court records.
Judge John D. Bates, U.S. District Judge for the District of Columbia, heard oral arguments Monday on Padilla's request to be released from federal custody.
Bates denied the request Tuesday.

(28,979 posts)A conversation between two grandmothers has led to a New Jersey man being charged for participating in the Capitol riot, NJ.com reports. Authorities say that days after the insurrection, the mother of Robert Petrosh Jr. of Mays Landing told her friend that Petrosh had been one of the mob who broke into the Capitol building. Her friend then repeated the gossip to her grandchild. In turn, the grandchild turned the information over to the FBI, authorities say. Petroshs mothers friends grandchild wasnt the only one sounding alarms about the South Jersey resident, according to NJ.com: On Jan. 10, an anonymous tipster told the FBI Petrosh had been on the steps of the Capitol building on Jan. 6. Then an FBI employee who had known Petrosh for over 15 years recognized him in security footage shot within the building, NJ.com reports. After taking a look at Petroshs drivers license photo and comparing it to the Jan. 6 security footage, the FBI apparently knew they had their man. Petrosh turned himself in earlier this week, and on Tuesday was released on a $50,000 bond. He faces multiple charges related to the attempted insurrection.

After attending a rally for then-President Donald Trump, Wickersham "marched to the U.S. Capitol where he observed others cursing, screaming, knocking cops away, breaking windows and doors, and entering the Capitol," according to FBI documents.
Inside the Capitol, he saw protesters and police officers involved in what looked like a "rugby scrum," he told the FBI, and said that he thought the whole scene wasn't real.
"The defendant believes that the whole event was staged and that law enforcement purposefully did not have enough resources there so that supporters of the former president could overrun the Capitol and be subsequently labeled as 'intruders,'" according to the FBI's charging document.
Despite that theory, he blamed the insurrection on Antifa protesters, according to the FBI.

On Wednesday afternoon, as insurrectionists assaulted the Capitol, a man wearing a brown vest over a black sweatshirt walked through the halls of Congress with the Confederate battle flag hanging over his shoulder. One widely circulated photo, taken by Mike Theiler of Reuters, captured him mid-stride, part of the flag almost glowing with the light coming from the hallway to his left. Just above and behind him is a painting of Charles Sumner, the ardent abolitionist senator from Massachusetts.
On May 22, 1856, Sumner was attacked by Preston Brooksa pro-slavery member of the House of Representatives from South Carolinafor a speech Sumner had made criticizing slaveholders, including Brookss cousin Andrew Butler, a senator representing South Carolina.* Brooks attacked Sumner on the Senate floor. Mr. Sumner, I have read your speech twice over carefully. It is a libel on South Carolina, and Mr. Butler, who is a relative of mine, he said. Before Sumner could fully respond, Brooks began beating him over the head with the golden head of his thick walking cane, trapping Sumner under his desk as he tried to escape, until two representatives were finally able to intervene and bring him out of the chamber. Sumner did not return to the Senate for three years, and would experience ongoing, debilitating pain for the rest of his life.
