He will remain out on bail until the completion of the retrial. Nucera's attorney Rocco Cipparone Jr. said he plans to appeal the conviction.

In delivering the sentence, Kugler said it "must be made clear" to police officers and the public that Nucera's conduct cannot be tolerated.

"Too lenient of a sentence, the public will lose confidence in the integrity of the justice system. Given that risk, a serious consequence must follow," Kugler said. "Chiefs of police cannot lie to the FBI about a very important matter."
