Lori Vallow Daybell found incompetent to move forward with court proceedings

ST. ANTHONY — A psychological assessment has determined Lori Vallow Daybell is incompetent to move forward with further court proceedings.

On Thursday, District Judge Steven Boyce issued a stay — or hold — on the case based on the assessment. The order indicates her attorney requested the evaluation after her fitness to proceed was called into questions. On March 8, Lori’s entire case was put on hold pending a competency evaluation.

The results show Daybell is not mentally sound to proceed to trial and it recommends she undergo treatment. It’s not clear what that treatment will entail or where it will occur.

In the order, Boyce also notes that prosecutors contest the finding of this report. As a result a hearing will be scheduled at a future date. Until then the stay on the case remains in effect. It’s unclear if the future hearing will be open to the public.

She was collecting social security money for the dead kids. She managed to get married in Hawaii. It's not like she was irrationally running around, these crimes were beneficial to her.
Now she is incompetent?

Never mind her previous husband who was shot dead by her now deceased brother. They managed to pull that off by claiming self-defense, and not get charged with anything. She expected to be a beneficiary of his life insurance, only he changed it to his sister before his death (and Lori didn't know that he changed the beneficiary). How does that happen with an incompetent person?

mentally ill to know right from wrong. This smells just like another manipulation and probably an attempt to throw hubby under the bus and blame it all on him. I'm glad the prosecution is objecting. I saw her brief court appearance yesterday and she was staring up at the ceiling with a mask on acting out of it. I share the prosecution's skepticism.

is not about knowing right from wrong, that's an insanity defense. Legal competence is - do you understand the legal proceedings, can you make rational decisions, and can you assist in your defense. I have no idea if she is competent or not, but let's understand what is being said here. And yes, you could fake it, but eventually people will catch on.

Almost everyone in here is confusing the two. As another poster said, yes, it can be faked, but it is never faked for very long.

This has nothing to do with being organized.

I think she is guilty as hell, and she and Chris Daybell should never breathe air outside prison walls again, but she very well may be legally incompetent.

prosecution has its doubts, too. The person evaluating Vallow Daybell or whatever she calls herself now is a clinical psychologist, not a psychiatrist so I hope the state finds an MD to evaluate her. If she's not faking, fine. Treat her then try her which is what would happen.
