(115,831 posts)A first offense for drug possession rarely results in any jail time. Specifically, the presumptive sentence for fourth-degree controlled substance possession is one year and a day, stayed (no jail time as long as they don't commit other crimes). A person might get the maximum only if there were a number of other prior or concurrent offenses involved (sale or distribution, sale to a minor, use of a firearm, multiple prior convictions). Extrapolating, he can get out after 2/3 of his sentence, which would be after 15 years. If the drug possessor get the max (most likely not) he/she would get out after 10 years.
Personally, I wouldn't want to spend one day in prison.

(7,611 posts)For a diversionary program which would avoid a conviction entirely. That's pretty common in states these days.
