How do you envision it would go?
Would he take the Fifth? Would he bring a bevy of lawyers with him?
Would he answer any questions or would it be mostly chaos?
What could the Justice Dept do if he refused to answer the subpoena?
Would Democrats take it easy on him?
Interesting scenario but I doubt it will ever happen.

(52,166 posts)If they are going to even think of issuing subpoenas to him they are going to have to create a separate rocket docket for the litigation that surrounds them. Otherwise, they will never get any testimony from him.

(52,166 posts)Yes he is able to be indicted if he did illegal things but that is different from being hauled before Congress. I can't imagine this not being litigated.

(26,758 posts)Remember that Congress' powers are far from absolute. They aren't law enforcement. They can only issue subpoenas in connection with legislating/oversight. Trump isn't President any longer, so the oversight rationale would be thin (would they claim that they're working on another impeachment?)... and he would have plenty of grounds to claim in court that there's no valid legislative purpose for such an interview.
At the very least, such court fights would last for years.
