Rachel pointed it out in last night’s show, and other than AP’s own reporting, there was no source to verify the claim that Garland’s DOJ had declined to prosecute- in fact, all public reporting, some from 2019-20, prior to AP’s report, was to the contrary and indicated it was Trump’s DOJ.

or if they just closed the file without doing anything. It would also depend on the evidence DoJ already has, if more is needed, and whether any statutes of limitations have run.
