Federal appeals court upholds CDC's eviction moratorium

Federal appeals court upholds CDC's eviction moratorium

The big picture: President Biden let an earlier moratorium lapse, fearing an extension would be struck down in the courts.

The CDC issued a new moratorium in early August after progressive lawmakers pressured the White House to act unilaterally amid a COVID surge driven by the Delta variant.

Federal judges so far have kept the ban alive.

U.S. District Judge Dabney Friedrich denied the landlords' request to pause the moratorium last week despite her belief that the policy is illegal.

While Biden's new moratorium wasn't technically an extension, Friedrich said it should be considered one.

Here's what actually happened the weekend the moratorium extension was expiring.

Anyone who was watching could have seen the whole thing unwind from July 30 to August 2 by following Nancy Pelosi and Maxine Waters' strategic release of intra-party letters and and sundry reports to the press.

----------------------------------------------------------------------------------------------------------------------------------

And here's the outcome of the Waters/Pelosi/Biden strategy:

Representative Waters, Speaker Pelosi, and President Biden secured the rent moratorium extension, protected House members in swing districts, avoided involving the Senate, and forestalled Republican accusations of executive branch and CDC overreach, all because Brett Kavanaugh's concurring opinion in the SC decision opened the door. (Maxine Waters found that avenue after the bill she sponsored and introduced on July 29 stalled in the House.)

And where was Leader Schumer while this was all being planned out? On the steps of the Capitol with Cori Bush, getting his picture taken and helping to keep the press distracted and busy.
