If there had been no big, centralized plan before 1/6 it would be easier to prove that TFG incited the mob in his rally speech to storm the capital. It's apparent that some individual groups like the Proud Boys had that intent beforehand, but if the majority of the dumbasses who turned up on 1/6 hadn't planned to take over the Capitol until TFG told them to do it - which is what the FBI's findings imply - he is more, not less, culpable.
