If there's a new panel of justices that hear a new case, would the USSC overturn the overturning of Roe? Will it be immediate or will it take decades?

(26,721 posts)In no sense did they overrule Roe. All they did was fail to respond to an emergency appeal before a law went into effect. They didnt even reject it
they just havent responded. That could happen at any point.
And even if they did respond this morning with a rejection
the emergency request has nothing to do with the merits of the case. No court has ruled on the law itself. That, too, could happen at any time.

even the majority makes clear that the decision has nothing to do with the constitutionality of the law itself and is based on the fact that none of the people being sued can enforce the law (and thus cannot be ordered not to enforce the law)
Its pretty clear that the law will be put on hold as soon as the first real case is filed

Im sure that Roe will be narrowed in a year or two, but not enough for this Law to survive long-term
