DeSantis ban on school masks back in place

Jacob Ogles
September 10, 2021

... An appellate court has put Florida’s ban on school mask mandates back in place— at least for now.

“Given the presumption against vacating the automatic stay, the stay should have been left in place pending appellate review,” reads an order from the First District Court of Appeal.

Since the state of Florida has appealed a circuit court ruling against Gov. Ron DeSantis’ order forbidding mask mandates, the appellate said that ruling should have been stayed. That means the Governor’s order should remain in place.

Further, the order makes clear appellate judge’s at least see a legal argument for the state to make on appeal ...

A second judge is considering whether to block Iowa's law banning school districts from enacting mask mandates.

Lawyers argued in federal court Friday morning before U.S. District Court Judge Robert Pratt, who has yet to decide whether to issue a temporary restraining order that would block enforcement of the law.

A decision could come soon. A state court judge is also considering similar action in another lawsuit challenging the law in Polk County.

In the federal case, the parents of 11 students with disabilities and the Arc of Iowa, a disability rights group, are suing the state, backed by the American Civil Liberties Union. They're arguing the law violates the Americans With Disabilities Act and the Rehabilitation Act by effectively excluding students with disabilities from public schools and equal access to education since they're at higher risk for COVID-19 ...

FRANKFORT, Ky. (AP) — Democratic Gov. Andy Beshear on Friday gave a blistering review of the Republican-led legislature’s decision to halt statewide mask mandates to combat Kentucky’s worst COVID-19 surge.

Instead of leading, lawmakers “punted” masking decisions in schools to local superintendents and school boards, the governor said a day after the legislature ended a three-day special session.

The legislature passed bills Thursday that scrapped a statewide mask mandate in public schools and imposed a prolonged ban on any statewide mask mandate. In doing so, GOP lawmakers overrode the governor’s vetoes of the provisions ending blanket masking requirements ...
