(26,751 posts)There is a theory that would allow a committee action to be enough for Pelosi to send the referral, but it has never been done that way and it's unlikely that the courts would allow it.
Plus... the committee voted to recommend it to the full House for consideration. So that isn't an option at this point.

(26,751 posts)If you're going to hold someone in contempt of Congress... Congress needs to vote.
This has some recent support. A lawsuit involving Trump and House Democrats died because even a bunch of representatives can't represent the House itself without a House vote telling them so... and a bunch of Democrats (absent that vote) lacked standing to sue.

Which does not bode well for the survival of democracy in the long run.
I'm beginning to understand why democracy is failing rapidly around the globe including right here in this country.
