(9,961 posts)... I'm still pro-Garland. ...but not prosecuting Crooked Donald because "he's no longer a sitting President" is a very weak excuse. he can't be prosecuted when he's President and he can't be prosecuted when he's not President? That's stupid.

(7,284 posts)Although Garland of course didn't explicitly say so in the hearing, he gave himself and the DOJ cover on the point of no commenting on investigations until a charge is being brought, the follow up from Cohen should have questioned the policy of running the clock on a criminal running for office, especially campaigning for the office of the presidency.
No comment until charged would be fine if the practice of running the clock or burying, shutting down investigations for political and other reasons wasn't a well established mode of operation for both FBI and Justice Dept since the beginning of both institutions.
I'm reminded of how corrupt both institutions have notoriously been just on the Whitey Bulger case.
I'm not sure either institutions are concerned about repairing their credibility in a meaningful way beyond some sort of PR campaign.

(5,256 posts)Rep. Cohen, in his question, briefly summarized the procedural history to date of the Stormy Daniels matter. Rep. Cohen stated, as part of that summary, that per DOJ policy, Mr. Trump could not be indicted while he was a sitting president. Rep. Cohen then stated that Mr. Trump is "no longer a sitting president."
AG Garland then simply responded that the DOJ doesn't comment on ongoing investigations until there is a charge.
So Garland's response does not merit any anxiety at all among Democrats and opponents of Mr. Trump. In fact, you could more reasonably read it the other way.
