As of now, the National Archives remains on track to turn over to the House a number of documents on Friday, including White House call logs, video logs and schedules related to January 6 as well as three pages of handwritten notes from Trump's then-chief of staff. The outcome in court also could help the House in its pursuit of more information from those around Trump, including witnesses who've been subpoenaed and haven't spoken to the committee yet.
"The court holds that the public interest lies in permitting -- not enjoining -- the combined will of the legislative and executive branches to study the events that led to and occurred on January 6, and to consider legislation to prevent such events from ever occurring again," Chutkan wrote in a 39-page opinion.
The judge, in her ruling, shut down Trump's arguments in court on several fronts.
She decided that a former president's wishes couldn't overcome the decisions of the current president regarding protecting privileged information of the executive branch. "It is the incumbent President who is best situated to protect executive branch interests,"
She also knocked down Trump for any attempts to protect himself out of secrecy. Presidential privilege "exists for the benefit of the Republic, not any individual," she wrote. Because of that, Congress and the courts can access presidential communications when there's a need to inform the public, the judge decided.
In this case, the judge said she wouldn't look at Trump's records document by document and wouldn't second-guess the Biden administration's decision to release them. She also noted that though the committee has made sweeping requests for requests, it does "not exceed" its legislative power.

(102,418 posts)Just as most of us would have if given the chance. I'm not saying she is biased against Trump (as I clearly am), but once the facts were so self-evident, she made sure her opinion was delivered without question.
That's gonna leave a mark!

Rachel Maddow reports breaking news that a federal judge has ruled against Donald Trump's effort to block the January 6th Committee from obtaining Trump era White House documents. (43,362 posts)From all the political philosophers of the Enlightenment, from state of nature to natural rights to inalienable rights, from power derived from the rule of the governed, to the potentate as head of state, from Constitutional monarchy to Leviathan, Machiavelli to Hobbes to Rousseau to Locke, Montesquieu and all the rest. They struggled to derive and explain political power in the absence of kings. In TFG we have someone who thinks himself a throwback by way of privilege and greed to the Divine Right of Kings.

(43,362 posts)Modern Political Thought and Amerian Political Thought are 2 courses every college student should take. We study the depth of our political system about as much as we teach personal finance to protect us from loan sharks and Wall Street - which is to say NOT AT ALL!

(269,212 posts)I remember when all majors in Social Sciences had to read at least first year courses such as Introduction to Politics, Introduction to Political Philosophy, Introduction to Sociology and Introduction to Economics. These days those courses are optional for the business and marketing majors.
It's why we're in this mess.
