Boeing reaches deal to settle damages for Ethiopian Airlines crash

The Boeing Co. (NYSE: BA) admitted liability in the fatal 2019 Ethiopian Airlines 737 Max crash in a deal it reached with victims’ families in Illinois federal court.

The motion filed jointly by the parties Wednesday tees up settlement negotiations or a jury trial to determine damages and limits the risk that Boeing would face future lawsuits over the crash.

Boeing “has admitted that it produced an airplane that had an unsafe condition that was a proximate cause of Plaintiff’s compensatory damages caused by the Ethiopian Airlines Flight 302 accident," the filing said. The company does not allege anyone else bears responsibility for damages, including the pilot and co-pilot, against whom Boeing will not “ascribe fault or seek contributory or comparative negligence.”

All 157 passengers and crew aboard the flight were killed in the crash, which was the second of two incidents that caused the FAA to ground the 737 Max for 20 months. The Renton-built Max is Boeing’s highest-selling plane.

The filing also limits Boeing’s financial liability and any investigation by the plaintiffs to compensatory, rather than punitive, damages.

Settlement has to be revealed so as to be subject to review and challenge in court.
