(9,736 posts)as in, "My learned friend has misrepresented the evidence," or, "The distinguished prosecutor evidently does not understand the situation at hand." I think the judge should admonish the defense attorney. But I'm not a lawyer, so what do I know?

(7,447 posts)more than you think but yes it absolutely should be admonished on the spot...having said that, prosecution can use that to their advantage on rebuttal if they are good.
When you make wild claims like that while the other person gets the last word, you risk looking real stupid.

Kyle RITTENHOUSEs lawyer knows that the ADA gave a tremendous closing, accurately pegging the defendant as the ACTIVE SHOOTER/MURDERER that he is.
An officer of the court NEVER calls another attorney a LIAR.
That is a reportable offense to the State Bar.

(5,969 posts)but the prosecutor seemed way more likeable, eloquent and despite the topic, his style of presentation was pleasant to listen to. I guess it doesn't play that big of a rule for the jury but the defense attorney is the exact opposite.

(3,869 posts)The prosecutor opened himself up to such statements by making demonstrably false claims in his opening statement that were shown to be wrong by the FBI drone footage.
So he was either lying or he was not familiar with the evidence in the case he was trying. I'm not sure which is worse...
Between this and the dropped gun possession charge that could have been avoided by using a simple measuring tape, the prosecution has really botched this case from the beginning.

You point out the facts and let the jury come to its own conclusions.
