Why would he hire a new lawyer to overturn his sentence in jail? Im confused how one could even possibly try this!

(7,611 posts)I am sure made promises he can't possibly keep. The first guy who got about a year for a felony did the same thing. After a while he gave up.

(4,787 posts)Ineffective assistance of counsel. The 6th Amendment guarantees defendants the right of assistance of counsel: SCOTUS ruled back in 1984 that ineffective assistance of counsel, as defined by a test set out in their opinion, violated the defendant's 6th Amendment rights.
The appellate lawyers opining on this on twitter don't believe he'll prevail. Also, his new lawyer, Jon Pierce, is eyeball-deep in bills and is soliciting donations for this work. (He's the lawyer who went MIA a few months ago, leaving some of his 1/6/21 clients temporarily without assistance in court.)

(16,100 posts)That there should be a law...where if a lawyer is found to be ineffective counsel...that lawyer is suspended from practicing law for 2 years...and is required to retake the Bar Exam!!!
