If Devin "retires" at the end of the month, does Governor Newsom get to appoint his successor? Does it have to be someone from the same party? Or does he leave the spot open and call a special election?

at the end of his term in 2022. But no, the governor cannot appoint new congressional members, only senators. There would have to be a special election called to fill the vacancy to the end of the term.

There was a second report that indicated he might be leaving at the end of the year for a gig with the new Trump Media Company.

The spot stays open until Newsom sets an election date, he can only appoint Senators, not House members.
