Finally, Everyone Is Talking about Trump’s Obstruction on January 6
December 14, 2021/101 Comments/in 2020 Presidential Election, January 6 Insurrection /by emptywheel

But for the moment, it seems that all three branches of government — prosecutors charging obstruction, judges affirming the viability of the application, and senior members of Congress invoking it as part of the January 6 investigation — agree that the events of the day may amount to obstruction.

Back when I begged TV lawyers to start focusing on this application, I laid out the things that Trump had or may have done, that might be proof of obstruction.

Agreeing (and ordering subordinates) to plan and participate in an effort to obstruct the vote certification
Encouraging the Proud Boys to believe they are his army
Personally sowing the Big Lie about voter fraud to lead supporters to believe Trump has been robbed of his rightful election win
Asking subordinates and Republican politicians to lie about the vote to encourage supporters to feel they were robbed
Encouraging surrogates and campaign staffers to fund buses to make travel to DC easier
Using the January 6 rally to encourage as many people as possible to come to DC
Applauding violence in advance of January 6 and tacitly encouraging it on the day
Recruiting members of Congress to raise challenges to the vote count
Asking members of Congress to delay evacuation even as the rioters entered the building, heightening the chance of direct physical threat (and likely contributing to Ashli Babbitt’s death)
Asking Mike Pence to do something unconstitutional, then targeting him after he refused, virtually ensuring he would be personally threatened
Possibly muddling the line of command on which civilian agency would coordinate response, ensuring there would be none
Possibly taking steps to delay any Guard response at the Capitol
Possibly ignoring immediate requests from help from leaders of Congress

The January 6 Committee has already collected evidence demonstrating many of these issues, for example, the efforts to sow the Big Lie, including coordination with Congress, reveling in the collecting mobs, directing Guard deployment in ways that would support the insurrection, the unbelievable pressure on Mike Pence to violate his oath to the Constitution. In the interim four months, the press and Committee have identified other potential means of obstruction, such as ordering Alex Jones to bring his mob to the Capitol.

This is not a guarantee that Trump will be prosecuted. But all three branches of government now agree on the framework with which he might be held accountable.

side. I have every confidence it will rivet American eyes and open ears the msm has been trying to keep shut…for what reason still puzzling over that.

Also confident Americans will be horrified and defeat fascism. Again.

that there is a financial upside to a fascist takeover. Corporations are not patriotic. They slavishly pursue profits over anything else. And they likely calculated that they will be in business no matter what kind of governing prevails. If they can increase viewership and ads during a government overthrow, all the better.

from GQP's corporate media in my mind was mainly a cover up for 1/6/2021. But alas, the documentations and evidence are finally being exposed and therefore, GQP's corporate media can't really ignore the findings re: investigations. Although fake news has already begun to deter and blame others, as usual. Their fucked up cult will remain because the "truth" doesn't jive with their twilight reality.

It has a suspenseful dramatic tick-tock that, if properly presented, will keep viewers tuned in even though we know the ultimate outcome was that Congress certified Biden as the winner of the 2020 presidential election.

Februrary, in the dead of winter, when most people are home at night would be the perfect time.

The select committee has exceeded expectations. The states are going after Trump. New York and Georgia are taking Trump on.

I listened to Liz Cheney Monday and Tuesday, the most important thing she said was that Trump impeded the official proceedings of Congress, she cited a specific law that carries an 8 year jail sentence. Liz Cheney was speaking to one person, she was speaking to Merrick Garland. Prosecutors were criticized by several judges for not asking for stiffer penalties for "insurrectionists who obstructed Congress." If DOJ prosecutors are listening to these judges and asking for stiffer sentences, I say, it's about time. DOJ did nothing other than write a stern letter when pro-Trump Cyber Ninjas broke federal election laws when they were given access to voter information, election materials and equipment which were no longer in the possession of election officials. This non action by DOJ has resulted in fraudits in numerous other states which are designed to perpetuate the Big Lie.

If DOJ is finally acting, hip hip hooray. I hope it doesn't take them longer than 3 weeks to decide on Mark Meadows.

I would still like to see Merrick Garland appoint a special counsel just like Bill Barr appointed John Durham and put guardrails around him/her just like Barr put guardrails around Durham so that he couldn't be fired.

There may soon come a time when DOJ has to carry the ball by itself.

wondered about. Think November 12th... How in the world did they know that it was the safest election ever. Just as a layman struck me as way too soon to make that determination. I mean I'm glad they said it but if I was the other side I would definitely say how would you know at that point. Shhh

“The November 3rd election was the most secure in American history. Right now, across the country, election officials are reviewing and double-checking the entire election process prior to finalizing the result,” the coordinating bodies on election infrastructure and security said in a joint statement issued by the Department of Homeland Security’s Cybersecurity & Infrastructure Security Agency (CISA).

In real time and in living color.

It's one of the benefits of exposing these scumbags with evidence and documents galore. Make them squirm. Make them sweat. Then throw the whole gang over to criminal prosecutors.

I want these public hearings aired in prime time. Fox can run 'squirrels gone mad' 24/7. Trump's die hard supporters can sing la-la-la as loud as possible. Trump will no doubt screech until he's hoarse.

But the truth is a-coming in all its finery.

High time for the high-treason of January 6th to be exposed and all those involved excoriated.
