Remington Arms agreed Tuesday to settle liability claims from the families of five adults and four children killed in the massacre at Sandy Hook Elementary School, according to a new court filing, marking the first time a gun manufacturer has been held liable for a mass shooting in the U.S.
The settlement comes nearly eight years after the families sued the maker of the Bushmaster XM15-E2S semiautomatic rifle that was used in the 2012 mass shooting in Newtown, Connecticut.
"The plaintiffs in this action hereby give Notice that a settlement agreement has been executed between the parties," the filing said.
More details are expected to be announced at a news conference from the families.

(51,200 posts)However, this was more than a nuisance suit and I think it's fair to assume that Remington had reasons to believe a jury would have dinged them more severely.

(18,774 posts)Trial cost, likely jury result, and the bankruptcy.
Remington was probably concerned about the first two and the plaintiffs about the latter two. Factor in how long appeals would take (and costs) both parties were probably willing to settle.
This way both can claim victory as well.

The settlement is very little comfort to me, though it's better than nothing.

(34,183 posts)I feel bad for the families even though I don't think Remington did anything wrong.
But held liable seems to be the wrong phrase here.

I'm truly glad they're paying up. I hope it helps the families & causes other manufacturers to think twice.

Just less than $3M per victim? Nowhere near enough, but then, neither would $3B be.

(6,211 posts)There's going to be a lot more lawsuits coming.
And, if there is an armed insurgence instigated by Trump's radical base, it could be more than just financial judgements.
The gun makers know their products were made for one purpose only...to kill or maim large numbers of people in a very short time. And yet they still produce them.

The families were never interested in monetary settlements except to inflict pain on Remington.
I hope that part of the settlement is the release of those internal documents.

(7,263 posts)However I'm so glad the families are getting something.
But much work still needs to be done to stop the sales of these deadly weapons to the public at large.
Guns kill People.
Yes they do.
It's a fact - that is what these type weapons are designed to do.
No word games here.

(15,290 posts)Not only that, but they got the right to make the material public. The lawsuit was never primarily about the money.
Betting that once these materials are organized and made public, they will start popping up in the 2nd Amendment cases now working their way through the courts.
The families also got all the insurers who insured Remington to pay up. The financial settlement is going to cause insurance companies to think twice now about insuring gun manufacturers that market military weapons to the general public. If a manufacturer cannot get insurance, they are less likely to keep making the uninsurable product.
