In order to be defamation, you have to say something that is false and you have to know it is false. Just because someone wasnt convicted doesnt mean they are a not murderer, an acquittal doesnt prove innocence, just insufficient evidence of guilt. In order to prevail in a lawsuit, the plaintiff would have to show they were not in fact a murderer. If that person was, say, O. J. Simpson, they would have a hard time with that.
If you are found to have committed defamation, you can be held responsible for monetary damages to that persons reputation, sometimes to the tune of millions of dollars. In extreme cases, it can become a criminal matter.

(1,336 posts)He should've been convicted. I feel the jury was corrupted by media and/or personal views kept to themselves and lied to the court that they will be impartial. The victims never had a fair and just trial.

He flitted around to this show and that show and plastered himself all over the place in the media before, during and after the trial. He's now a public figure. Because he made himself one. He, very much like Palin, won't be able to meet the VERY high standard. Boo fucking hoo, someone called you a murderer. Good luck little boy. What's his material damage? Didn't republicans give him millions?

He was Flavor of the Day in conservative circles, but now he's grown stale.
He'll have trouble proving he is not a public figure (who have less protection under libel law) when he keeps appearing on TV and public events.
