Looks like Cawthorn will be on the ballot.

Cawthorn update:

US Dist Court Judge Richard Myers blocks state candidate challenge proceedings against Rep. Madison Cawthorn. He ruled that the 1872 Amnesty Act forgave insurrectionists retrospectively and prospectively.

Think on that while I get my story up.

Sounds like a very fucked up opinion. I'll post follow up when I see it.

It appears this Trump judge accepted Cawthorn's theory that NO ONE can be disqualified from the ballot for engaging in insurrection because the 1872 Amnesty Act applies prospectively.

That is an extremely bizarre theory. https://slate.com/news-and-politics/2022/02/madison-cawthorn-insurrection-amnesty.html

Even though Myers is a Trump nominee, I truly did not think he would embrace this theory. It simply cannot be right.

How does an Act of Congress to forgive the confederates apply to crimes that are committed 150 years in the future?

And I think the real hang-up is that, in order to claim he was involved in an insurrection, it must first be proven there WAS an insurrection. Not in the court of public opinion, not from what we all saw on the TV, but an actual court verdict with the determination that the riots elevated to the level of seditious insurrection per the Constitution. Then and only then can Cawthorn's situation be properly and legally addressed.

I kind of get it, but I still want this asshole smoked out sooner rather than later.

So perhaps that defense is also out the window for Mr. Cawthorn.

May he commence his slow roll to hell presently.

My thought would be that he would allow Cawthorn to run because he couldn't be denied the right to run for congress without due process.

To say a law that forgave Confederates was prospective for future rebellions is fucking nuts.

He may as well be saying insurrection or sedition is perfectly fine

How does the amnesty act square with this?

I guess I know what we can totally do if Republicans get the majority in November.

The system is so rigged in their favor though, it's clear we need other means to do so.

Paint Cawthorne as anti-American and unpatriotic.
