US Dist Court Judge Richard Myers blocks state candidate challenge proceedings against Rep. Madison Cawthorn. He ruled that the 1872 Amnesty Act forgave insurrectionists retrospectively and prospectively.
Think on that while I get my story up.

It appears this Trump judge accepted Cawthorn's theory that NO ONE can be disqualified from the ballot for engaging in insurrection because the 1872 Amnesty Act applies prospectively.

Even though Myers is a Trump nominee, I truly did not think he would embrace this theory. It simply cannot be right.

(9,670 posts)And I think the real hang-up is that, in order to claim he was involved in an insurrection, it must first be proven there WAS an insurrection. Not in the court of public opinion, not from what we all saw on the TV, but an actual court verdict with the determination that the riots elevated to the level of seditious insurrection per the Constitution. Then and only then can Cawthorn's situation be properly and legally addressed.
I kind of get it, but I still want this asshole smoked out sooner rather than later.

(9,481 posts)My thought would be that he would allow Cawthorn to run because he couldn't be denied the right to run for congress without due process.
To say a law that forgave Confederates was prospective for future rebellions is fucking nuts.
