(2,347 posts)A tRump appointed Federal judge said a federal law that pardoned Civil War rebels overrode the 14th Amendment section that bars insurrectionists and traitors from serving as elected officials, and so, kicked the lawsuit that sought to have him disqualified from the ballot.
Based on the faulty logic that a law overrides a constitutional amendment, I don't think we've heard the last of this case.

(113,043 posts)Jeff Jackson would bury him. In 2020 Jacksons district was gerrymandered by NCGOP to +5 Republicans and he still won by 5%.

(58,647 posts)If we grant that the court leans "conservative" but not necessarily partisan republican in some cases, I think this is one.
If you have a strong "states' rights" bent, it makes it more difficult for the Federal judiciary to override and state court decision involving voting regulation and adherence to the state constitution.
Regardless of why, this is a win.
