A Mesa County grand jury returned 10 criminal counts against Mesa County Clerk and Recorder Tina Peters and six counts against Deputy Clerk Belinda Knisley in its investigation over a potential election equipment security breach.
The grand jury was empaneled at the end of January to investigate the election equipment tampering and official misconduct allegations and returned its findings Tuesday evening. Peters has been charged with three counts of attempting to influence a public servant, conspiracy to commit attempting to influence a public servant, criminal impersonation, conspiracy to commit criminal impersonation and identity theft, all felonies, according to the Mesa County District Attorneys Office. She is also charged with first-degree official misconduct, violation of duty and failing to comply with the secretary of state, all misdemeanors.
Knisley was charged with three counts of attempting to influence a public servant, conspiracy to commit attempting to influence a public servant, all felonies, and misdemeanors violation of duty and failing to comply with the secretary of state.
The district attorneys office said in a statement that investigations are ongoing and more charges could be added, but arrest warrants have been issued for these counts.

(8,679 posts)just for the record, mesa county isn't the ONLY county/persons in Colorado being investigated for these charges. The authorities have discovered the possibility of the same, I think in C.Springs area???????? And they are continue to look.......

(32,351 posts)She should be CHARGED with tampering and destroying county property, and FINED for the cost of replacing those machines. Every District Attorney in every state needs to make it clear that individuals who tamper with secure voting machines will be financially responsible for replacing them with brand-new machines. Neither the counties nor the states should have to shoulder that cost.

Even destroying those specific machines might not be enough. Someone now possibly understands the internal architecture allowing them to reverse engineer access keys.

Although IMO we need to return the entire country to paper ballots.
This comes from someone who spent 25 years in the computer industry.

(6,703 posts)The state, the nation, the world all fell for the hanging chad charade. Not even as complicated as a mechanical typewriter, that machine was perfect for the job. The card readers were tamper averse, if there was suspicion of cheating, fraud or simply error, the solution was to just count the cards again. I remember that once there was a box of cards that no one could account for. A notable occasion in my little corner of Kentucky. Turned out they were blanks that had never been used but, apparently, the local newspaper had a slow news day. The chain of custody for the actual ballots was simple, easily confirmed and worked flawlessly and with basic logic. The paperless data criterion has been a ridiculous waste of effort. It begs for tampering at every level and is a needless complication for a basic and essential function. I vote locally on a ballot sheet which is then read by a machine and the original ballots are then, I suppose, carried to a safe storage place. The machine's tally is compiled with the totals from all the other machines. I don't know where or even if the various sub-totals are compiled and stored for reinspection should the need arise.
I know I was concerned the first time I used it. The assistant at the machine said it wasn't a concern that I would insert it upside down since it read it either way. I thought it an unessential machine complexity which meant, to me, an opportunity to manipulate the data. I still think of it every time I slip it into the machine. I mean, my credit card won't let me use IT upside down, does yours?

I'm thinking of a system that's closed on election day to any changes, but available to the public so anyone can watch any particular machine crunch the numbers (and note anything that doesnt make sense)?
I hope I'm correctly communicating what my brain is thinking lol

(6,435 posts)one such is the old classic "How to Win Friends and Influence People". It's not illegal to try and get people to see things your way. It's, like i said, what i do when i call my rep. Currently i've been on their case about an upcoming change in the Solar Recs i receive. So to my mind "attempting to influence a public servant" can't cover what she did wrong (unless the law is inaptly named)... it would have had to have been something more serious, like bribing or threatening an official.

Any person who attempts to influence any public servant by means of deceit or by threat of violence or economic reprisal against any person or property, with the intent thereby to alter or affect the public servant's decision, vote, opinion, or action concerning any matter which is to be considered or performed by him or the agency or body of which he is a member, commits a class 4 felony.

I was solely remarking on the phrase "attempting to influence a public servant", which is an absurd name for a statute. I also clearly stated the offender must have been doing something more than coaxing and cajoling.
