I guess it still can, but more and more its become a tool of the wealthy and powerful to stymie the efforts of the common man and even the government. The wealthy can afford lots of lawyers to tie things up so long that those without the resources give up. This is helped by some judges. I dont think thats new but seems to be increasingly common.

They've been packing the courts with political agents of their big power blocs at every opportunity for decadess -- the religious right, social conservatives, the wealthy, business, white nationalists, cronies, cronies, cronies. They've just gotten more extreme this century.
Every time Republicans get majorities, they try to stack the electoral system.
Every time Republicans get majorities, they eliminate regulations on business.
Every time Republicans get majorities, they divert national wealth to the wealthy.
Every time Republicans get majorities, they try to oppress and deny equality to many.
Every time Republicans get majorities, they build corruption and dysfunction into institutions they control.
EVERY time. 100% predictable. Note that that last one builds in problems that can take years to undo -- once Democrats get power long enough.
