That's what a federal judge said. Eastman was claiming attorney/client privilege, was claiming executive authority, and the judge was having none of it. He said no privilege when you and Trump most likely committed a felony.
Fucking eh, Nicolle is back, and she led her show with this.
Frank Figliusi made the point that DOJ better not be waiting for referrals, they should be doing what the select committee has been doing. He said he hopes DOJ has been investigating, but he then said that with this judge putting out such a bold statement, DOJ will have no choice but to investigate Eastman and Trump.
Claire McCaskill just body slammed Merrick Garland into the ground, she sounded just like a lot of people here at DU when she asked Garland, "what is taking so long?"
Welcome back Nicolle, she then went after Clarence and Ginni Thomas.

The judge bent over backward to find that Eastman had an attorney client privilege with TFG and that Eastman did not waive such privilege when Eastman improperly used Chapman University's email system. These were close issues and the judge gave the benefit of the doubt to Eastman and TFG.
The discussion of the crime fraud exception really made me smile

(20,850 posts)but I feel this is finally different. Garland cannot ignore what a federal judge just put in writing, that Trump and Eastman likely committed felonies. If Garland doesn't follow up on that he needs to resign.

AG Garland and his folk are working this case. I am sure we will see something soon. Were all getting impatient, but given the political angle on this, he has to make sure everything is perfect or else it just gets passed off as a political stunt. He really does have to make sure this is tied up in a a tight bundle. Youre right, if we dont see much action soon, we will all be unhappy

(30,613 posts)He can't try, convict, and sentence Trump all by himself. Best he can do is shame Garland into getting the ball rolling, while also forcing Trump and Eastman to disgorge the documents.

(20,850 posts)this is finally some good news. I was so encouraged by Claire McCaskill's attack of Garland. I finally feel that DOJ will be forced to act. Figliusi and Claire both said that Garland was a DC circuit judge so he understands what just went down.
Figliusi said that DOJ should be acting without referrals.
