The abrupt resignation of Mark Pomerantz and Carey Dunne, who headed the DAs investigation of Trump under former DA Cy Vance, has raised serious questions that serve to undermine the publics confidence in the integrity of the district attorneys investigation. Pomerantzs extraordinary resignation letter, which detailed his reasons for leaving, and the recent reports that prosecutors are now returning documents to people who turned over information about Trumps business hardly support the new DAs claim that the investigation continues.
Together, we have practiced criminal law as a prosecutor and as criminal defense attorneys for more than 85 years. We embrace the ethical principle that prosecutors should not normally publicly comment on ongoing investigations. But the facts and circumstances of the Trump investigation compelled two highly experienced and respected lawyers to suddenly resign after years of work cry. This cries out for answers to restore public confidence in one of the countrys most highly respected prosecutors offices.
Pomerantz, a former federal prosecutor, in fact came out of retirement to lead the investigation at the behest of then-DA Vance. Dunne had served as the DAs general counsel and had distinguished himself by his successful argument that resulted in the Supreme Courts decision that Trumps personal taxes had to be turned over to prosecutors. Pomerantzs resignation letter did not mince words when he stated that the prosecution team that had been investigating Trump harbors no doubt about whether he committed crimes he did. He went on to say, I believe that Donald Trump is guilty of numerous felony violations of the Penal Law in connection with the preparation and use of his annual Statements of Financial Condition. His financial statements were false Based on the evidence that the DA had obtained and analyzed, he left no doubt that the decision to not prosecute Trump is misguided and completely contrary to the public interest.
Bragg must explain why the public interest of the people of the state of New York does not warrant Trumps prosecution based on the evidence that was already in hand at the time of his assuming office in January 2021. At the very least, why not present all the evidence that his office already obtained and leave it to the grand jury to determine whether there is probable cause to believe that Trump committed felonies? What is the evidentiary basis for his decision to halt the grand jurys consideration of evidence when the prosecutors who had been working on the investigation for years so strongly believed that the facts warranted charging Trump, were compelled to resign rather than remain silent in the face of an injustice?

Alvin Bragg looks great on paper, but something is going on. He needs to come clean, ican't possibly be worse than what people are thinking about him.

(46,154 posts)Demanding answers from elected politicians is hardly accusing them of corruption, nor is it out of bounds. In fact, it is the essence of democracy, which simply MUST have transparency to function properly.

(13,685 posts)our elected officials are accountable to us. (Sadly, Bragg isn't DA of Brooklyn, so there is little that I can hold him to account for. But I can be angry at his lack of willingness to do the work when there is plenty of evidence of wrong doing.)

(52,027 posts)great stories started because of a whiff of impropriety or a suggestion of scandal or a hint of a crime. The evidence comes from the subsequent investigation. Hence the name.
And this situation is a lot more than a whiff or suggestion or hint. It stinks.
Also, stating an opinion on DU is now a "rant from the blogosphere?" Are you on the "Don't talk about it because you aren't an expert" 8 Ball again?

(56,211 posts)and decline to prosecute trump in just a month and a half on the job when the chief prosecutors had worked for years on the case and were ready to indict.
It was not smart to think he could not move forward on the case and it would just go away unnoticed without repercussions. Not smart.
It wlll all come out.

(5,973 posts)although Cy Vance doesn't come out of this smelling like roses, either. He could and should have moved forward before leaving office instead of turning things over to Bragg. Was there an agreement, tacit or otherwise, to let Vance evade responsibility, with the knowledge that Bragg would then kill the case? Either way, this stinks.

I had thought when we finally got rid of Vance things would improve...

Thanks for reminding me, I was already dubious about the guy when Goldman didn't win. It became clear the whole facility is probably set up to protect the wealthy in perpetuity.

(54,770 posts)indicting him yet either, Bragg has other issues to deal with and probably doesn't want to devote all the DA's resources to an indictment that will likely fail unless they find that witness, etc.
But hey, Pomerantz -- a 70 year old who apparently wasn't making it at the law firm where he worked previously -- says trump is guilty and Bragg, a duly elected Democrat, needs to be recalled.
Before this is over, we'll eat more of our own, lose midterms and maybe 2024 elections. . . . . . . and trump keeps sticking it to us.

(56,211 posts)trump case. It had nothing to do with him not doing well at his firm. And the two prosecutors said they had clear evidence of trump's guilt. The had the receipts and that needed doing was to present it to the grand jury.
Something smells with Bragg's decision.

He couldn't have went through be a fraction of the evidence in that short time.
Something smells and there will repercussions. The prosecutors' resignation letter raised many questions and now the Daily News is coming out with stories on why the case was droppled.
Bragg hasn't heard the last of this.

Many articles say Vance "hired" Pomerantz. Admittedly, others say he was working pro bono.

Clearly, we know the documents were lies. But someone has to tie that to trumps doing. Thats the problem.
Even if they deposed a banker, what can they say? We knew trump was lying, but gave him the loans anyway. That wont convict trump.

(54,770 posts)Mosby is facing federal charges of two counts of perjury and two counts of making false statements on a loan application.
The indictment now includes a letter that prosecutors said Mosby sent her loan broker as part of a mortgage application for the property she purchased in Longboat Key, Florida.
The letter, dated Dec. 10, 2020, mentions Mosby already has another property near Disney World, and she and her family had been living there for the previous 70 days.

Totally different, plus Mosby and her husband filled out the documents themselves, not relying on a CFO, etc.

(15,796 posts)would be a hard case to prove because "corrupt" intent goes to the mindset of the accussed. As posted upthread, Trump can claim credibly that he relied on his accountants, CFO, etc and had no idea they were giving him incorrect information. He just signed what he was given.
Vance had enough documentary evidence to indict Weisselberg, but he has refused to flip. The DA needs someone to be a "tour guide" through the Trump Org and how its inner circle operated, but don't have one right now. Maybe when Weisselberg goes on trial and is facing the real prospect of jail for himself, his son or both of them, he'll decide protecting Trump isn't worth it and turn on him.
Michael Cohen knows a lot, but has too many of his own credibility problems for prosecutors to rely on him as their star witness against Trump.
As tempting as it might be to bring a case, prosecutors want above all to win. Jmho, but at the moment this isn't a slam dunk win if it would go to trial. It's better to let the civil case play out first. NY AG James has the power to disestablish the entire Trump Organization if her investigation finds Trump and the kids guilty.

(13,685 posts)that his being Manhattan DA is so consequential in NYC and I was unable to vote for or against him. (I live in Brooklyn and we have our own DA race.)
I don't know which DA candidate would have been the best candidate in that race in regard to pursuing charges against Trump. At this point, I would like to see all the work that has already been done be given to other prosecutors (like the AG's team). Bc I don't trust Bragg to do anything with this.

(34,598 posts)Vance was the DA for New York County for 11 years, and no indictments were issued to the Chump family or to the Chump organization for a very long time. "Was he scared, or was he corrupt?" were the implications. If he was neither then surely the Chump family members would be in jail very soon. And this was even BEFORE Chump ran for president, so there was a lot of frustration in the Big Apple.
Just before he left office DA Vance threw down the hammer and declared that the case against Chump should finally proceed. Whoops, ran out of time, so I'll just leave this for the next guy to finish up. Now Bragg has come in and shut it all down. The whole thing stinks like 3-day old fish.
