General Discussion
Related: Editorials & Other Articles, Issue Forums, Alliance Forums, Region ForumsDoes the Attorney General serve at the pleasure of the President?
Can a president fire his Attorney-General at any time and replace him?
For example, if the present AG did nothing to pursue an investigation against Trump and his criminal cabal before the next election, could Biden replace him? If he wanted to?
Or does there have to be "cause" to relieve an Attorney General?

(5,811 posts)positions in the federal government is trying to educate the American people about how different federal departments operate based on law (the establishment of a federal agency) and administrative rules setting policies and procedures to implement law.
Unfortunately, many Americans believe if I can't see it then it's not happening. The other unfortunate issue is that NO one is willing to tell the American people the starting gate truth. The only Secretary who did so was ignored even though he said it several times.
The truth that's hiding in plain sight is that the the right wing of the GOP overthrew the United States government. Trump said so with this comment at one of his hate rallies. "We won everything but the election.
The people who helped made it happen include GOP House and Senators, both current and former, donors both foreign and domestic, governors and members of statehouses and local governments and most horrific and dangerous, the federal judiciary, including the Supreme Court.
DOJ is conducting a massive SECRET NATIONAL SECURITY criminal investigation. While I expect to see Trump, Kushner, Stone, and Trump's adult children and others indicted, I also expect at least four justices to also be indicted.
You can't see anything because it's national secutiy which means there are foreign actors involved. You can't see anything because there's probably a GAG (UNDER SEAL) order on all communications, filings and proceedings. I imagine everything is being handled
through the FISA court

(110,950 posts)The trick for the DOJ is to NOT make it about Trump or the Republicans, but to make it about the rule of law and the saving of our democracy.
It is the rule of law and democracy that will be on trial.
If certain Republicans do not wish to save our country, then let them stand up.

(7,638 posts)criminal investigation, how did you find out?
underthematrix
(5,811 posts)there's no criminal investigation.
My assumption makes more sense because unlike a reality tv show, the Justice Department doesn't conduct it's investigations in public and treat Americans like they're part of a fan base.
Why would I assume it's a national security criminal investigation? Have you read any of the books about Trump's time in the White House? Trump was a national security risk when he ran he 2016 and remains a severe risk now.
Finally, Trump said "We won everything except the election." From his perspective and based on the lawlessness of his co-conspirators, I would say he's right. He did overthrow the federal govt, which includes a severely compromised Supreme Court.
So if Trump and Trumplicans overthrew the govt who do you think they're investigating? Just Trump? No. They're investigating GOP House and senate members. They're investigating the Federalist Society and at least five of the justices. They're investigating members of the military and on.
What I find so disturbing is this idea if I can't see it, it's not happening.

I would love to be wrong, but nothing seems to be happening. Biden can fire or seek his resignation for any reason he chooses. AG's are often only around for a couple of years. The limitation on firing him is really more political than legal.

As I've said before, I think it's time to forget trump -- who was convicted by the only court that really matters, voters -- and move on to things people need.
But, I recongize retribution is hot.

(7,759 posts)unlike the Mueller investigation that leaked like a sieve, an investigation that was hobbled by Rod Rosenstein and "disappeared" by Bill Barr, the DOJ's January 6 investigation is shrouded in secrecy as it should be...the width and depth of the insurrection is without precedent...I'm frustrated as hell, and as much as I would like Trump caged in a high security prison for the criminally insane like yesterday, we have to get off Merrick Garland back and do his job ...when he indicts Trump, the evidence has to unequivocal..a slam dunk...

(7,759 posts)the J6 committee gives us a whiff what they are investigating because almost everyday there's a new revelation of Trump's involvement..the DOJ is independent of the J6 committee..to be honest, I'm frustrated with the committee..the committee can rail against the DOJ for their perceived inaction, but other than last night's roll call to hold Scavino and Navarro in contempt do we know when the J6 committee will hold hearings?..the date is alway in flux..we as a country need a reckoning..if the committee hearings are to precede a DOJ Trump indictment then start the damn hearings...

(30,613 posts)There is video proof of Trump committing rebellion, insurrection, and sedition, not to mention innumerable media posts he made, doing the same. This should have been a slam dunk the day Garland got confirmed.

(7,759 posts)think about what Garland knows now that he didn't the day he was confirmed...and when he does indict (please,God!), the evidence has to be incontrovertible, nailed down, no daylight, and that takes time...I understand your Garland frustration but I'm kinda not too happy with the J6 committee, lots of tantalizing teasers but no hearings, no report...
