The lying war criminal Bush appointed John Roberts to replace Sandra Day O'Connor. Before Roberts made it through confirmation, Rehnquist died and Bush announced Roberts would be replacing the chief justice instead, and nominated Harriet "Best Choice" Meyers to replace O'Connor.

So maybe we'll get lucky and corrupt Clarence Thomas will leave the planet in the next few weeks.

...simply changing his mind about retirement once Jackson was confirmed.

I'm not sure there is much that could be done about it either, given that the only way to oust a sitting Supreme Court Justice is apparently through impeachment and removal, which there certainly would not be the votes for in a Democratic-controlled Senate.

Which was my point. Basically Breyer backdoor helping to expand the court and somewhat help right the wrong of the seat stolen from Obama. Jackson is confirmed and is seated as a Justice and Breyer simply decides he doesn't want to retire and keeps serving as well. From what I understand, there is no device to remove a sitting Supreme Court Justice other than impeachment and removal, which almost certainly would not happen with the House and Senate under Democratic control.

She would need to be nominated and confirmed to a different seat to fill it should it become vacant.

Roberts was 1st nominated to fill Sandra Day O'Connor's seat (h/t to madaboutharry for the reminder about this). Then, when Rehnquist died, W withdrew Roberts' nomination for O'Connor's seat and nominated him for Rehnquist's Chief Justice seat.
