Like the other presidents before and after him, Bill Clinton appointed a number of judges to federal courts during his White House tenure. One of those was Donald Middlebrooks, who has been on the U.S. District Court for the Southern District of Florida for more than two decades.
That fact is not a good enough reason for Middlebrooks to recuse himself from hearing Trumps lawsuit against his 2016 presidential nemesis, Hillary Rodham Clinton, the judge said Wednesday.
Middlebrooks denied a motion Trump filed Monday in which he claimed that his role as a judge in the case amounts to prejudice so virulent or pervasive as to constitute bias against a party.
The judge also made note of Trumps apparent attempt to file the civil suit in a court whose judge was one of his appointees: I note that Plaintiff filed this lawsuit in the Fort Pierce division of this District, where only one federal judge sits: Judge Aileen Cannon, who Plaintiff appointed in 2020. Despite the odds, this case landed with me instead. And when Plaintiff is a litigant before a judge that he himself appointed, he does not tend to advance these same sorts of bias concerns.

Clinton Lawsuit Judge Laughs Trumps Disqualification Demand Out Of Court
The judge overseeing ex-President Donald Trumps mammoth lawsuit against Hillary Clinton and a slew of other 2016 political enemies rejected Trumps request that the judge disqualify himself on Wednesday.
Trump had requested that that the judge, Donald Middlebrooks of the Southern District of Florida, step aside because he was appointed by Clintons husband, ex-President Bill Clinton.
In his decision, Judge Donald Middlebrooks said it wasnt lost on him that Trumps legal team had initially tried to file the lawsuit in a division of the Southern District of Florida thats presided over by a Trump-appointed judge, Aileen Cannon.
Despite the odds, this case landed with me instead, Middlebrooks wrote in his decision.

Middlebrooks observed that Trump filed his lawsuit in the Fort Pierce division of the Southern District of the Florida federal court and that the only District Court judge who sits in that division is a Trump appointee. However, under the courts docketing system, the case wound up assigned to Middlebrooks, who sits in West Palm Beach.
Despite the odds, this case landed with me instead, Middlebrooks wrote, suggesting that Trumps legal team was judge-shopping seeking to get the case in front of a judge who might view it favorably. He also quoted an appellate precedent observing that recusal demands are sometimes driven more by litigation strategies than by ethical concerns.
