General Discussion
Related: Editorials & Other Articles, Issue Forums, Alliance Forums, Region ForumsI guess I'm naive, but what about the first amendment. Does DeSantis simply overrule that????
How can he ban the word gay/discussions in k-3rd grade. This entire thing is insane, that we now ban words too along with books. Yet another total WTF. Please, someone tell me how he simply overrules the first amendment, plus promotes lawsuits against free speech. Does a governor just overrule the first amendment? ... does it only apply to congress? Can you imagine what this guy would do as president "if" he were to win in 2024. He's an extremely dangerous character. Trump on steroids, but a GOP darling. He's dangerous to anyone in a democracy IMO.

(34,452 posts)The First Amendment DOES apply, but court cases have spelled out limitations. There is a lot of info on the web about this topic.

(11,308 posts)public servants are generally expected to advance the philosophies and agendas of the division/entity they work for. (much the same as the private sector) And, it's pretty easy to see how a teacher, cop, social services/welfare worker, public health official, etc., that is just totally off the reservation - would quickly present (and run into) serious issues.
(and most assuredly when they are 'on the job', representing said government entity - as would be the case when teaching 3rd grade)

(94,571 posts)The school administration and State Government have the right (for better or worse) to decide what constitutes curriculum. The teacher can speak freely outside the classroom.

(5,842 posts)That is government-compelled speech, a clear violation of the First Amendment, and I can't understand why it was never fought in court. Can a lawyer tell me why that is allowed and not a violation of the First Amendment?

(5,842 posts)...forcing doctors to tell women seeking medication-induced abortions that the process can be reversed once it has begun.
Unsupported by science, not true. There is no methodology to reverse medication-induced abortion. For that you need clinical trials, studies. That hasn't happened. It is only a theory, and unsupported at that.
But let's not get in the way of punishing women for asserting autonomy over their own lives and bodies.
