https://www.washingtonpost.com/nation/2022/04/22/florida-teen-speeding-six-killed/Noah Thomas Galle, 18, had a history of recording himself speeding through southeast Florida in a 2019 white BMW and later posting the videos on social media, a criminal affidavit states. His Instagram handle was displayed on the car windows, and in at least one video, Galle offered $25 to anyone who could correctly guess his rate of speed, according to the report. On Jan. 27, one of those stunts turned fatal, a Palm Beach County Sheriffs Office report states.
That evening, Galle, driving the BMW at 151 mph, struck the back of a 2018 gray Nissan Rogue, causing the SUV to flip multiple times before coming to a halt, according to the report. All six people in the Nissan Rogue, which landed upside down, were killed. When interviewed by law enforcement at the scene, Galle, then 17, confirmed he was the driver of the BMW, which had no other occupants, court records state.
Rich kid speeding in a Beamer kills six undocumented farm workers? Heck, DeathSentence will probably give him a medal!

(65,168 posts)I remember hearing that the highest speed is stored on the chip. Is that true?
If so, the kid is toast.
Of course, the physics after impact would establish it anyway.
That said, I don't know anything about Florida's vehicular homicide laws.

(4,448 posts)Highest speed ever recorded? I doubt that would be permitted to be entered into evidence.
ProfessorGAC
(65,168 posts)We agree that speed is legitimate evidence. And, it's not that hard to accurately estimate probable speed at impact with simple Newtonian physics.
So, we agree on all that.
But, I'm confused as to why the computer chip data wouldn't be allowed as evidence. Why would that be?

(6,625 posts)I'll take a shot at that: Because a record of the single highest speed ever recorded for that vehicle may or may not be date/time-stamped to show that it coincided with the accident in question. He may have gone 151 mph at another time, which may have even been legal if he had taken his BMW to the "track day" events sometimes held at motor racing venues.
If the chip records the date and time of its "highest ever" speed record, then it's a different story.
ProfessorGAC
(65,168 posts)I guess I'm presuming a computer would record time & date, but that isn't necessarily true. Just a possibility.
If it's not time-stamped, I agree completely that it's useless, except perhaps as an example of reckless disregard.

(9,894 posts)we recently had a drunk driver mow down two state troopers and the guy they were trying to help on the median on I95. She had previously bragged on Facebook about what a great drunk driver she was. Just before the accident she was stopped for speeding by these same troopers, at which point she posted wondering why they had stopped her. You can't fix stupid.

I might have inferred incorrectly.

DU had an item last week. The prick videoed himself doing 180 +. The Sheriff didnt state
weather he was driving a standard BMW or the high performance one. Standard one cant
do over 155mph. It was an expensive car all the same. Can only hope he gets the maximum
sentence on each of six deaths.

(65,168 posts)I had a high performance Audi on the autobahn and got it to 245kph. (Around 150mph.)
We got passed by a car going at least 30mph faster than us. Not sure what it was but it had a supercar look. All I know for sure is it wasn't a Lamborghini. That's the only super performance car I can ID on sight.

(565 posts)The M versions are factory limited to 155 MPH.
There are several companies that offer software and/or hardware updates to unleash the true performance of the drivetrain.

(4,758 posts)It's an option at the time of purchase, the "M Sport Experience" or some such BS - they de-limit the car and give you a day of track instruction. TBH it's not that unreasonable, a 600hp übersedan limited to 155 is a bit silly - 205 isn't really any less safe on public roads.

FORT LAUDERDALE, Fla. Two weeks before a teen was involved in a 151 mph crash that killed six people in West Delray, he was going even faster in his luxury car on Interstate 95 reaching speeds of 182 mph, authorities say in newly released court documents. ... The 18-year-old, Noah Galle, posted a video of himself in his BMW M5 driving 182 mph on I-95 earlier in the month before the deadly Jan. 28 crash, according to a sheriffs criminal probable cause affidavit.
The new court documents portray Galle as a driver who tends to drive more than 100 mph beyond the speed limit and who boasts about it on social media. Galle, who was arrested on April 6, faces six counts of vehicular homicide in the West Delray crash. ... During the investigation into the crash, the Palm Beach County Sheriffs Office said it received a tip from a person who had recorded Galles videos on Instagram and TikTok in which he recorded himself driving at an extremely high rate of speed.
A search warrant for Galles Instagram account revealed Galle had filmed himself driving 182 mph on Interstate 95 past the Gateway Beach Boulevard overpass two weeks before the crash, the probable cause affidavit said. Investigators confirmed it was the same BMW driven in the crash due to the dashboard and instrument panel configuration shown in the video.

A standard 2019 BMW M5 is electronically limited to 155 mph, but the competition model allows the vehicle to reach 189 mph, according to a BMW dealer website. The BMW M5 competition model is priced at just under $111,000. The sheriffs report doesnt specify which type of BMW Galle had. ... The Palm Beach County State Attorneys Office officially charged Galle, 18, on Monday with six counts of vehicular homicide in the Jan. 28 crash that killed six workers who were leaving their jobs at Pero Family Farms. Each count is a second-degree felony punishable by up to 15 years in prison.
