Justice Clarence Thomas, following the leak of a draft majority opinion overturning Roe v. Wade, said Friday that government institutions shouldn't be "bullied" into delivering what some see as the preferred outcome.
"The events of earlier this week is one symptom of that," Thomas said. He added that "you cannot have a free society" without stable institutions.
His comments came before an audience of mostly judges and lawyers at the 11th Circuit Judicial Conference in Atlanta. Chief Justice John Roberts had addressed the same conference Thursday, calling the leak "absolutely appalling."
On Friday, Thomas also reiterated that he believes Supreme Court justices are obligated to take a fresh look at established precedent and shouldn't be bound by the judicial doctrine called "stare decisis." The legal principle is translated as "stand by that which has been decided" and is meant to reinforce stability in the law. Thomas has long been a critic of a strict reading of the doctrine.

(17,006 posts)down and shut the ef up, right? What if the justices had used Alitos logic for Loving vs Virginia? This is so clearly a partisan hit job even a blind man can see it. The only question is will we have the courage and determination to fight back.
