I kinda remember it was removed and blood thirsty Trump rushed to execute the last convicts in his last days.
But perhaps I am mixing things.
In his ABC reports on the Luguna Wood shooting by Taiwanese hater, Matt Gutman, I think said that if defined as a hate crime it could be subjected to the death penalty. California removed it but if this is a Federal crime it could.

At one point there was a moratorium on even seeking it.
Not sure if that was undone by tRump.

Murder is murder, regardless of whether it's sanctioned by the government or not.
Not that it's the best argument, but killing a killer gives them an easy out.
