(18,733 posts)Texas does not require background checks for sales by private individuals, along with about 40 other states. Licensed dealers must do a background check regardless where the sale takes place.
There was a 1994 survey that claimed almost 40% of sales did not involve a background check. That almost 40% was rounded up to 50%
I found this study Firearm Acquisition Without Background Checks, funded by gun control organizations that estimated 22% is a more accurate number.

(453 posts)Now if they are sold by a private person they are not, but at that point they are a secondary sale. But they where sold with a back ground check to the original owner for almost the last 30 years, and handguns in most states for longer than that.
Just pointing out the laws.

Anyone who holds a current and valid Texas License to Carry is exempt from having a background check completed, even when purchasing at a federally licensed gun dealer.
So they don't do a background check at the time of sale if the buyer has an active Texas gun license, because a check was done when that license was issued.
