DOJ still arresting, still convicting

Jim Roberts @nycjim 3h
Kevin and Hunter Seefried, a father and son duo from Delaware, are convicted of felony charges in Capitol riot.
*Dad carried Confederate flag. *Officer Goodman says he was jabbed with the flag.
*Obstruction count carries max sentence of 20 years.

Roger Parloff @rparloff 7h
For those coming in late, Kevin and Hunter Seefried are father and son from Laurel, Delaware. Kevin was the man who carried a full sized Confederate battle flag into the Capitol for possibly the first time in history.

thread: twitter.com/rparloff/status/1537155994383536128

Hunter, the son, punched out shards of glass from the right window pane on the window to the right (looking from outside) of the Senate Wing Door, after another rioter (allegedly Edward Kelley) broke it with a 2x4.

The govt believes Hunter was the 4th rioter to enter the Capitol building (he jumped in through the window he cleared) while Kevin was 13th. (The 1st was allegedly Michael Sparks, who jumped in the pane that Proud Boy Dominic Pezzola broke with riot shield at 2:13pm.)

Kevin and Hunter are charged in an 8 count indictment, although the last 3 counts pertain only to Hunter (because they relate to the broken window). Only count one is a felony: corruptly obstructing an official proceeding.

The crux of the trial is over that felony—the issue being intent. Unlike with most Jan 6 defendants, the govt couldn’t find incriminating remarks on social media made by either Seefried. (Kevin deleted his Facebook account on Jan. 7.)

...(Judge) finding that Kevin did obstruct an official proceeding ... obstructed the certification (the felony)... govt has proven intent also through Kevin's statements: where are the members at? where are they counting the votes at? ... Kevin did make these statements.

Defense had argued that Ofc Eugene Goodman had not have remembered these statements accurately. But McFadden credits Goodman's testimony. ... Found Goodman credible. ...

now Hunter (the son) ... he did obstruct a proceeding (felony conviction) this is one element of the crime, not whole crime. did he intend? put limited stock in his attendance at rally. not very poltically attuned. ... but actions at capitol are more damning.

So, in sum, both Seefrieds are GUILTY of counts 1-5, *including the felony.* Hunter NOT GUILTY of counts 6-8 relating to the window (with which Kevin had not been charged).

The felony count carries a potential max of 20 years...

There was a belief that he would be lenient.

Let's see what they get as a sentence.

"Kevin Seefried is to be sentenced on Sept. 16, 2022. Hunter Seefried is to be sentenced on Sept. 23, 2022. The felony charge carries a statutory maximum of 20 years in prison and potential financial penalties. The four misdemeanor offenses carry a combined statutory maximum of three years of incarceration and potential financial penalties. The Court will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors." from https://www.justice.gov/usao-dc/pr/delaware-men-found-guilty-charges-actions-related-capitol-breach-0

But they never seem to put what the actual sentence is in these cases.

...I'd take more notice of the charges and convictions for obstructing the vote certification (proceedings).

That's another indication that DOJ is focused on tying the Capitol invaders to the plot to overturn election results.

No, the ones immediately referenced have not even been tried yet. But it is a fact that with other cases people have always said what the max sentence is but then when they get a slap on the wrist that is ignored. Very few have been sentenced to any real prison time.

A dude from Delaware with a Confederate flag. Isn't Delaware "yankee territory"? Is that the symbol of racism now?
