Clarence Thomas Signals Same-Sex Marriage and Contraception Rights at Risk After Overturning Roe v.

In his opinion concurring with the Supreme Court’s decision to overturn the constitutional right to abortion established in Roe v. Wade, Justice Clarence Thomas wrote that the high court should revisit all cases built on similar legal footing—including cases that guarantee the right to contraception, same-sex consensual sexual relations, and same-sex marriage.

All three cases—and numerous other landmark decisions—are built upon the right to substantive due process found in the Fifth and Fourteenth Amendments of the Constitution, which prohibit the government from depriving “any person of life, liberty, or property, without due process of law.”

In 1973, the Supreme Court held it was the Due Process Clause of the Fourteenth Amendment that protected a woman’s right to an abortion before fetal viability—the point around 24 weeks of pregnancy where a fetus can survive outside the womb. Since a leaked draft opinion previewed the overturn of Roe in May, progressives have been sounding the alarm that other rights rooted in substantive due process could be similarly under threat

Not trying to minimize the huge loss of Roe v Wade. Just it's clear they're not done.

From privacy rights, Same sex marriage and contraception are next.

Not enough public support, even in deep red states. Same with interracial marriage, no state is touching that one.

Same sex marriage is a different story. Plenty of political capital for that in some states.

Are there some people who would want to ban it? Of course. But I don't think there is a single state where anywhere close to a majority of the people or state legislature would support it.

And they were naive. Roe was always 5 votes away from being overturned and there were generally 4 sitting justices willing to do it. Abortion bans were always popular in multiple states and there were many States that continually attacked Roe and were itching and ready to go as soon as they had the votes on the court.

The same can not be said for birth control.

So, if you have something, show it. Otherwise admit you don't have any support for your assertion.

2011 isn't ancient history.

46% is a majority when 16% wouldn't respond. Meaning 40% believe it should be legal.

11 years is not "recent". And one state is not Republicans in general. One poll is not multiple polls. And 46 percent is a plurality, not a majority.

That man has one huge chip on his shoulder, dating back to his confirmation hearings for the unpardonable sin of having to account for his inappropriate actions.

Ginni could have been leading the charge on Jan. 6; he will not retire or recuse himself from anything that ends up before the court relating to it.

I thought when I started watching The Handmaid's Tale on Hulu that it just couldn't get that bad here. It can and it will the way things are going.

All this from the party that doesn't give two shits about children after they are born.

He loves hurting people - from Anita Hill as an individual, to many vulnerable groups. It's obvious this asshole's goal in making it to the ECOTUS was to inflict pain and misery, and tear apart freedom and rights. No doubt he is loving being on an extreme, right-wing activist court, and knowing they can cause more damage. Yesterday was just the beginning.

You know what error needs to be corrected? You being on the Court. Confirming you was a mistake then. It's become a bigger mistake with each passing day of your heartless, evil ass holding one of those 9 seats.

Even terrorists don't hate America the way this creep does.
