On Thursday, the Court reversed the presumption against state jurisdiction, holding that unless Congress acts to preempt state jurisdiction, states can prosecute non-Indians for all crimes committed in Indian country. Writing for the court, Justice Brett Kavanaugh listed several of the court’s precedents that conflicted with the Worcester, concluding that “the Worcester-era understanding of Indian country as separate from the State was abandoned later in the 1800s,” presumably meaning the McBratney and Draper decisions.

that we can just slap abortion clinics on native lands.

I think folks also have to ask how the Hyde Amendment conflicts with the other idea of using Federal Land to build abortion clinics.

if members who were in the earlier majority were still in the Court. It’s been two whole years. The only thing that changed was the loss of RBG and the addition of Barrett. In your face to the other four justices.

My state Supreme Court just held that abortion is not a right under the state constitution. Just four years after they held that it was.

Stare decisis is dead.

Natives are often preyed upon during civil disputes by local L.E.O.'s. Now it will be ramned though local courthouses, cancelling Native Tribes autonomy.
