Per Rep. Lofgren, on Nicolle Wallaces show today. She isnt at liberty to discuss substance per committee rules. (Nicolle was surprised that Lofgren answered her q about this privilege.)
She mentioned that executive privilege was held by Biden, who hasnt invoked it, and attorney-client privilege, which is held by the client. But she didnt specify whether Cipollone tried to assert either.

(34,458 posts)Didnt say why (due to committee rules apparently). I inferred she was implying that some may be wondering whether Cipollone tried to assert executive privilege, but he cant do thatonly the current president can.

(14,764 posts)Cip couldn't do it, and once tfg was deposed he can't either.
It would take the current potus to claim executive privilege. And biden isn't. In fact, he released a statement saying he wouldn't protect anything the committee was after.....
Money privilage would be lawyer-client confidentiality. But since Cip was representing the white house, and not tfg, the white house is free to waive it.

(17,006 posts)WH is Biden so he would be the one to assert privilege. This has come up before and Biden declined to assert executive privilege then. Someone mentioned that Trump may not have clearly understood that Cipollone was not hi attorney.

(14,764 posts)I'm absolutely positive the office of wh council would have made that very clear from day 1. tfg simply ignored it. but he knew.
