I read a tweet thread a few days ago by a former JAG. In his entire long career he was only aware of 2 cases in which a person was recalled and then prosecuted. In both cases, the crimes had been committed while the person was in active service and both involved the rape and murder of children. He didn’t think Flynn could be recalled since his crimes were committed after he retired.

But for seditious acts against the United States, I believe that this traitorous fuck can be recalled to active duty. He, after all, is still being paid a pension by US!

But he likely won't. DoD doesn't care much on crimes committed after retirement, with very few exceptions. And Flynn isn't currently facing any charges nor has he been convicted of a sedition. DoD won't even think of doing anything unless that happens first.
