Indiana Dr. Caitlin Bernard reported 10-year-old Ohio girl's abortion, records show
https://www.indystar.com/story/news/health/2022/07/14/ohio-abortion-10-year-old-indiana-todd-rokita-dr-caitlin-bernard/65373626007/
The Indiana physician who provided abortion services to a 10-year-old Ohio girl who was raped disclosed the abortion in a form filed with the Indiana Department of Health and the Department of Child Services, according to records obtained by IndyStar through a public records request.
Indiana Attorney General Todd Rokita and some news outlets have called into question whether Dr. Caitlin Bernard, the Indianapolis OB-GYN who performed the procedure, properly reported the disturbing case, which has become a flashpoint in the national debate over abortion.
We're gathering the evidence as we speak, and we're going to fight this to the end, including looking at her licensure, Rokita said Wednesday on Fox News. If she failed to report it in Indiana, it's a crime for to not report, to intentionally not report.
Indiana law requires health care providers to report abortions they perform to the Indiana Department of Health, including whether the patient indicated they were seeking an abortion as a result of being abused, coerced, harassed or trafficked. Failure to do so is a misdemeanor.

After discrediting a report on a 10-year-old Ohio girl needing an abortion, Fox's Jesse Watters now targets the girl's Indiana doctor

JESSE WATTERS (HOST): Primetime covered this story heavily on Monday. Put on the pressure and now we're glad that justice is being served.
...
Ohio detectives did their part, but there's still a lot of unanswered questions besides the girl not needing to cross state lines to Indiana for the abortion and whether the alleged rapist's immigration status played any role in the cover-up.
Caitlin Bernard, the abortion doctor who performed the operation in Indiana, has a legal requirement to report the abortion to both child services and the state's health department because a ten-year-old isn't able to give consent and is, therefore, a rape victim. And from what we can find out so far, this Indiana abortion doctor has covered this up. Failure to report is nothing new, though, for Dr. Bernard. According to reporting from PJ Media, she has a history of failing to report child abuse cases. And our sources, as Trace mentioned, are telling Fox that Dr. Bernard's employer, Indiana University Health, has already filed a HIPAA violation against her. So is a criminal charge next? And will Dr. Bernard lose her license? Let's ask the Indiana attorney general, Todd Rokita. So what's going on, Todd?
TODD ROKITA (INDIANA ATTORNEY GENERAL): Jesse, thanks for having me on, but I shouldn't be here. All right. I mean, first of all, this is an illegal immigration issue because likely of Biden's lawlessness at the border and everything going on down there. That's why Indiana, as a non-border state, has actually filed several independent lawsuits on that. Then we have the rape. And then we have this abortion activist acting as a doctor with a history of failing to report. So we're gathering the information. We're gathering the evidence as we speak, and we're going to fight this to the end, including looking at her licensure. If she failed to report it in Indiana, it's a crime for to not report, to intentionally not report.

Indiana AG Todd Rokita claimed he couldn't obtain any records proving that Dr. Caitlin Bernard fulfilled her legal reporting duties. But FOX59 just got them through a public records request.

INDIANAPOLIS After Indiana Attorney General Todd Rokita threatened to go after the license of an Indiana physician who provided an abortion to a 10-year-old rape victim from Ohio, documents obtained by FOX59 through a public record request proved the physician not only filed a terminated pregnancy report but filed the report within the required timeframe.
The terminated pregnancy report, obtained by FOX59s Angela Ganote, shows that Caitlin Bernard, an Indiana obstetrician-gynecologist, reported the abortion on July 2, two days after the abortion was performed and within the three days required for terminations to be reported to the Department of Child Service and the Indiana Department of Health.
Bernard publically shared the story of the 10-year-old rape victims abortion in an interview with the Indianapolis Star earlier this month. The 10-year-old girl had been impregnated when she was raped by a 27-year-old in Ohio and traveled to Indiana to get an abortion due to Ohio banning abortions after six weeks following the U.S. Supreme Court overturning Roe v. Wade.
The story of the 10-year-old gained national attention with some news outlets and politicians even expressing doubt that the story was true. Republican Ohio Attorney General Dave Yost was among those who questioned the validity of the story on Fox News. Rep. Jim Jordan, a Republican of Ohio, called the story a lie in a now-deleted Tweet.

(14,061 posts)Hes looking to run for governor, but I dont think hell stop there. This is true political theatre, with real people getting hurt. This piece of grandstanding shit couldnt care less.
This is a man who took his young son to the border to investigate the immigration problem. It made for a nice photo op that Im sure hell use in campaign ads. What the fuck that has to do with his being Indiana AG beats me.
Lets not forget that this little girl *was* able to get the care she needed. Case of fortuitous timing. In another few weeks, Indiana may well be just as bad as Ohio. And Todd Rokita will be in the front row, cheering.

How can anyone have confidence in these people? If anyone ever wonders how innocent people get railroaded, just look at both of these AGs. Either you are a lying POS. Or really suck at doing your job. Either way, innocent people end up in prison because of your malfeasance.

(21,633 posts)a history of not reporting, which implies that she has failed to report some abortions, rapes, or child abuse in the past? Has anyone debunked this allegation, too?
What about the alleged HIPAA violation that the Indiana AG said was filed against the doctor by her employer? Is it true, or made up? Since she did not reveal the patient's name, is it a HIPAA violation for her to have spoken about the case in general terms?
Looks like the doc has grounds for a lawsuit for the lie that she did not report the current case of the 10 year old. She might be able to add the other allegations to her suit.

(32,791 posts)To the doctor, it's totally irrelevant who got the patient pregnant. In the case of a 10-year-old girl who is incapable of giving consent, it's already obvious that the patient was RAPED. Maybe she said yes, but it wouldn't have mattered. Maybe the guy was nice to her and bought her an ice cream cone, but it wouldn't have mattered. The patient was RAPED, because she wasn't old enough to give her consent.
The doctor has a duty to determine that it wasn't a family member, who might do it again, but that's all. Beyond that, the doctor treats the female patient makes every effort to save her life and keep her healthy. The patient needed an abortion because carrying the fetus to term and giving birth would have killed her and the baby. Dr. Bernard acted correctly, and I hope this becomes a lawsuit where she collects a lot of money.
